‘Not guilty,’ says Rahul Gandhi; seeks court permission to join Lok Sabha session

Congress leader Rahul Gandhi while maintaining that he was not guilty in the ‘Modi surname’ remark case, on Wednesday requested the Supreme Court to stay his two-year conviction, enabling him to participate in the ongoing sittings of the Lok Sabha and sessions thereafter.

At a rally in Karnataka’s Kolar in April 2019, Rahul Gandhi, in a dig at Prime Minister Narendra Modi, said, “How come all the thieves have Modi as the common surname?”

Gandhi, filing an affidavit before the top court said that he has always maintained that he is not guilty of the offence and that the “conviction is unsustainable” and if he had to apologise and compound the offence, “he would have done it much earlier”.

The complainant, Gujarat BJP MLA Purnesh Ishwarbhai Modi, in his reply before the Supreme Court, used slanderous terms such as ‘arrogant’ to describe him only because he has refused to apologise, stated Gandhi’s affidavit.

Using the criminal process and the consequences under the Representation of Peoples Act to “arm twist” Gandhi into apologising for no fault, is a gross abuse of the judicial process and ought not to be countenanced by this court, he added.

The affidavit further stated that Gandhi has an ‘exceptional’ case considering the offence being a trivial offence, and the irreparable harm that accrues to him as an elected MP.

“On the other hand, there is no prejudice caused at all to the complainant. It is therefore prayed for that the conviction of Gandhi be stayed, enabling him to participate in the ongoing sittings of the Lok Sabha and the sessions thereafter,” Gandhi said.

The complainant in Rahul Gandhi’s criminal defamation case in which he was convicted and sentenced to two years in jail by the Surat court over the ‘Modi surname’ remark, on Monday told the Supreme Court that the attitude of the Congress leader reveals arrogant entitlement and he doesn’t deserve any relief in form of stay on his conviction.

Rahul Gandhi has shown arrogance rather than being apologetic over his remarks and his attitude shows insensitivity to an offended community and contempt for the law, according to the complainant.

“At the time of sentencing before the Trial Court, the Petitioner far from being repentant or contrite, displayed arrogance. He said he did not seek any mercy from the court and would not apologise for any harm to the reputation of the persons he had defamed. Subsequent to the order of conviction and sentence, in a press conference, the petitioner said that he would never apologise in this case as he was not a Savarkar, but a Gandhi,” stated the affidavit filed by Purnesh Ishwarbhai Modi.

Seeking dismissal of Gandhi’s appeal, the complainant said, the Congress leader maligned a totally blameless class of persons by his reckless and malicious words.

Earlier, the Supreme Court sought a response from the Gujarat government and the complainant on an appeal of Gandhi challenging the Gujarat High Court order which declined to stay his conviction in the criminal defamation case.

After his conviction in the case, Gandhi was declared disqualified as MP from Kerala’s Wayanad on March 24 following notification of the Lok Sabha Secretariat.

He was sentenced to two years’ imprisonment which disqualified him as an MP under the rigours of the Representation of People Act.

WATCH: Bajrang Dal members hold demonstration in Delhi to protest against Haryana communal clashes

Members of Bajrang Dal on Wednesday held a demonstration near Delhi’s Nirman Vihar metro station to protest against the communal violence during a Vishwa Hindu Parishad (VHP) rally in Haryana’s Nuh on Monday.

According to a Hindustan Times report, the police and intelligence officials are keeping a close watch on the protests as agencies believe that it could create a ripple effect of the violence in Nuh.

Meanwhile, security has been beefed up at sensitive places in the national capital in the wake of violence in some districts of neighbouring Haryana, the Delhi Police said on Wednesday.

The Haryana Police on Tuesday said that mobs killed a cleric in a late-night attack on a mosque, torched an eatery and vandalised shops as communal violence that began in Haryana’s Nuh spilled over into neighbouring Gurugram, taking the death toll to five.

“Keeping in view the violence in some districts of Haryana, adjoining Delhi, elaborate security arrangements have been made at all sensitive places in Delhi and additional police forces have also been deployed where necessary.

“Any attempt to harm Delhi’s security and communal harmony will be dealt with strictly,” the Delhi Police said.

Talking about Nuh clashes, Haryana Home Minister Anil Vij said the situation in Nuh is under control.

“The situation in Nuh is under control…Around 44 FIRs have been registered. 116 people have been arrested till now. There is a conspiracy behind this. The way stones, weapons, and bullets were found, it seems there is a mastermind behind this. We will conduct a detailed investigation and take strict actions against the people involved in this.”

'Hopeful of getting justice', says Omar Abdullah as SC to start hearing pleas against abrogation of Article 370

As the Supreme Court is set to hear a batch of petitions challenging abrogation of Article 370 starting today, National Conference leader Omar Abdullah on Wednesday said what happened on 5 August, 2019 was “unconstitutional and illegal” and hoped that the people of Jammu and Kashmir will get justice.

Talking to news agency ANI on Wednesday, he said, “We are hopeful of getting justice. We are here on behalf of the people of Jammu and Kashmir with the hope that we can prove that what happened on August 5, 2019 was unconstitutional and illegal.”

Chief Justice DY Chandrachud-led five-judge constitution bench, also comprising Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai and Surya Kant, had on 11 July fixed 27 July as the deadline for filing written submissions and convenience compilations by different parties.

The bench had said the hearing will be held on a day-to-day basis except on Mondays and Fridays, which are days for hearing miscellaneous matters in the apex court.

Only fresh petitions are taken up on these days for admission hearing and regular matters are not heard.

It had appointed two lawyers – one each from the petitioners’ and the government’s side – to prepare convenience compilation and file it before 27 July, and made it clear that after the said date no documents will be accepted. A convenience note gives the court a snapshot of the entire case to assist it in quickly appreciating the facts.

It had said the Centre’s affidavit with regard to the conditions prevailing in Jammu and Kashmir after the August 5, 2019 notification repealing Article 370 will have no bearing on the constitutional issue to be adjudicated by the five-judge bench.

On that day the Centre had stripped the erstwhile state of Jammu and Kashmir of its special status and bifurcated it into two union territories.

Several petitions challenging abrogation of the provisions of Article 370 and the Jammu and Kashmir Reorganisation Act, 2019, which split the erstwhile state into two union territories – Jammu and Kashmir, and Ladakh- were referred to a Constitution bench in 2019.

Haryana communal violence: Did the police fail to act on time in Nuh?

Bollywood has often portrayed the police as the one being the last on the scene and unprepared. And it seems reel turned real in Haryana, as the authorities were caught on the back foot as violence first broke out in Nuh and then spread to Gurugram, Faridabad, and Palwal districts.

The clashes have claimed the lives of five people, including a young imam of a mosque, and injured at least another 50 people. The communal violence, which started in Nuh over a procession and then spread to other parts of Haryana, has also caused significant damage to public and private property.

Amid this violence and destruction, many are asking: Did the police fail to gauge already simmering tensions in Nuh?

The widespread violence

Since the initial clashes that occurred in Nuh on Monday, violence has spread to other parts of the state. Authorities have imposed prohibitory orders under section 144 of the Code of Criminal Procedure, shutting of schools for a second consecutive day and suspension of internet services. There’s also a ban on the sale of loose petrol or diesel. Moreover, many office-goers have opted to stay home and opt for the work from home.

The police, according to a Times of India report, have until Tuesday evening registered 44 FIRs and arrested 80 people.

On Tuesday night, several shops and shanties were set on fire in Gurugram’s sector 70. In Palwal district, a mob set over 25 huts in Parshuram Colony on fire. Earlier in the day too, people set fire to a roadside eatery in Gurugram’s Badshahpur. Some shops in the market nearby were also vandalised.

This violence was preceded by a mob targeting the Anjuman Masjid in Gurugram’s sector 57. Police said the slogan-shouting mob pelted stones and opened fire at the four people inside the mosque and eventually set the place on fire.

Haryana chief minister Manohar Lal Khattar reacting to the unfolding violence said that the Nuh incident appeared to be a part of a big conspiracy and warned of strict action against the culprits. “No rioter will be spared,” he said.

His minister, Anil Vij, echoed a similar statement, alleging the violence was engineered. “Somebody masterminded it but I don’t want to reach any conclusions. We will investigate this and every single person responsible will be brought to justice,” he said.

Signs of simmering tension

While the country is aghast at the clashes, there were telltale signs of escalating tensions between the two sides.

Prior to the Vishva Hindu Parishad’s (VHP) Nuh procession – the Brij Mandal Jalabhishek yatra – there had been rumours circulating that murder-accused Monu Manesar, who has been absconding for the past six months, would participate in the religious procession, angering many.

Police officials say Manesar did not ultimately come for the yatra but even his perceived presence raised tempers in Nuh as locals have been for long demanding his arrest complaining how he has been available for media interviews but the police have not been able to catch him.

In fact, some people had posted provocative messages warning him not to come to Nuh for the demonstration. One such person, identified as Mohammad Sabir Khan, posted on social media and threatened that “if Monu Manesar came to Mewat for the procession, everything would be burnt down”. An India Today report stated that the post, which went viral, was attached with a video that showed cylinders and other inflammable material. Notably, the video was shared hours before the VHP procession started.

Even Haryana lawmakers had been aware of the build-up of the tension between the two communities with Congress MLA Maman Khan even stating in the Haryana Assembly last week that there would be dangerous consequences to Manesar’s presence in Mewat region.

Police Speak

With the signs of an attack being imminent, the question then to be asked is – where was the police?

Many have claimed that the authorities faltered in Nuh – they failed to pick up on the simmering tensions between the two groups, local intelligence units failed to gather information from the ground and there was no police presence at the time when the procession began despite rumours that the infamous gau rakshak Monu Manesar would be present.

When asked about their apparent failures, Narender Bijarniya, Nuh’s acting Superintendent of Police told NDTV, “Mewat is known for its composite culture and brotherhood. This violence has been instigated by some people through social media. A grand religious procession used to go through ancient temples here, this is the first time it has seen violence. Some troublemakers caused it through social media posts.”

On the matter of the videos about warning of violence on social media, Bijarniya added that they never imagined such large scale violence could happen there. “We have been monitoring social media, and the district police had made arrangements accordingly. We never imagine such large scale violence could happen. There have been shortcomings, no doubt, that’s why the violence happened. Top officials are investigating it now to ensure this doesn’t happen anywhere again,” he said.

Nuh Deputy Commissioner Prashant Panwa said that an investigation into the communal clashes was underway. “Internet services have been suspended for three days. Section 144 has been imposed in the district. Curfew orders have been given… We appeal to all to maintain peace. All stranded people have been rescued,” he said.

WATCH: Rapid Action Force conducts flag march in violence-hit Gurugram's Badshahpur

A day after communal clashes erupted in Haryana’s Nuh during a Vishwa Hindu Parishad rally and the violence spread to parts of Gurugram, Rapid Action Force (RAF) conducted flag march in Badshahpur where two shops were set ablaze by a mob on Tuesday.

The two shops in Badshapur, one of the four sub divisions of Gurugram district situated on Sohna Road, were set ablaze around 2 pm by an irate mob. According to nearby shopkeepers, both their occupants had already fled to their villages on Monday.

Meanwhile, denying claims that work from home for employees was imposed in Gurugram in light of clashes in Badshahpur, the Gurugram Police on Tuesday urged people not to spread rumours.

Taking to Twitter, police said that all offices in the city are open and in operation.

“We condemn such information spreading rumors..All offices are open and working, no restrictions on commuting anywhere within & out of gurugram. Appeal to everyone.. kindly refrain to spread rumors and misinformation please,” the post read.

However, schools, colleges, and other educational institutes will remain closed on Wednesday in Gurugram as per the order issued by District Magistrate Nishant Kumar Yadav.

According to media reports, citing Nuh SP, 26 FIRs have been filed in the case in the district and as many as 116 people have been arrested so far.

Section 144 is still on in the district and mobile internet services have been temporarily suspended.

Haryana Chief Minister Manohar Lal Khattar on Tuesday termed the Nuh violence as “unfortunate” and said the attack on a VHP procession was “well-planned which pointed to a larger conspiracy”.

“In a well-planned and conspiratorial manner, the attack was carried out in Nuh to disrupt the (Brij Mandal Jalabhishek) yatra and the police were also targeted, which points to a larger conspiracy,” Khattar said in a tweet in Hindi.

Railway cop who shot 4 people on Jaipur-Mumbai train, sent for mental health check-up over killings

The Railway Protection Force (RPF) staff who killed four people on a Jaipur-Mumbai train on Monday has been sent for a mental health assessment, government officials said on Tuesday, ruling out any communal angle to the incident.

Chetan Singh, 33, killed his senior and shot dead three more passengers on the Jaipur-Mumbai Central superfast express. He was arrested while trying to escape.

A “comprehensive mental and psychological health assessment” of the RPF personnel is being carried out, Railway Ministry officials said. They have ruled out the communal angle – brought about by videos and posts on social media — and pointed out that the accused had also shot Hindus, including his own superior officer.

Four RPF personnel, including Chetan Singh and Tikaram Meena, boarded the train at Surat in Gujarat as part of an escort group posted on long-distance trains to protect passengers and cargo.

According to eyewitnesses, Singh, who appeared to be agitated, lost his temper and simply shot his senior. He then went from coach to coach shooting three more, including Ajgar Abbas Shaikh, 48, and Abdul Kadarbhai Mohammed Hussain Bhanpurwala, 62.

Singh had shown signs of poor health in the morning, after which he was asked to rest, officials said. He took rest for a while and then insisted he was fine, after which he resumed duty.

The Railway Ministry said it would look into the incident thoroughly after the medical report was released.

Constable Chetan Singh’s family described him as short-tempered and hot-headed.

The Western Railways has said they are conducting a high-level investigation. Singh was posted in Lower Parel, they said.
