JNU students’ union calls for boycott of semester registration process as new hostel manual with hiked room rent comes into effect

New Delhi: The Jawaharlal Nehru University Students' Union (JNUSU) has called for a boycott of the semester registration process on Wednesday and asked the vice-chancellor "to have a proper deliberation and work in the spirit of resolution" of issues.

The university has been seeing a standoff between the students and the administration over the issue of hostel fee hike for over two months.

On Monday, the JNU released a circular saying that the new hostel manual will be implemented from 1 January, 2020 with the hiked room rent even though the service and utility charges will be taken care of by the University Grants Commission.

The union said that the Delhi High Court had observed in its order on 23 December that the solution to the current crisis must be found by the VC only through dialogue with stakeholders - the university students. The administration held two meetings with the JNUSU on 26 and 30 December.

"While having communicated through informal channels that it would initiate dialogue with the JNUSU, in a shocking display of their insidious intentions, the administration brought out a notice that was in complete violation of a conducive environment where negotiations can further proceed," the JNUSU said.

It said that despite concerted efforts by the administration to penalise the agitating students, the JNUSU participated in the talks with the sincere intent to resolve the "crisis that the hostel manual has imposed on the students". "Even as the talks were going on, circulars were released by the administration which clearly shows that the administration still believes in the modus operandi of pretending to hold dialogue rather than actually holding one," the JNUSU said.

The semester registration process will begin from 1 January and will go on till 5 January. The students, who did not take exams, can provisionally register for the next semester and have to complete academic requirements by 20 January. "We note that the administration which was threatening to fail students and not let them register has now had to come down to the so called 'provisional registration' model. But that is a sham tactic. Proper exams with buffer period must be held for all students," the JNUSU said.

The JNUSU has decided to go for an extended boycott in the wake of the varsity's circular.

SMS services restored in Kashmir Valley after 150-day-long suspension; broadband links up in schools, state-run hospitals

Jammu: Broadband internet services were restored in government-run hospitals and SMS facility on all mobile phones since Tuesday midnight in Kashmir, after over four and a half months of suspension.

Internet services, landline and mobile phones were snapped across Jammu and Kashmir on 4 August, a day before the Centre's announcement to scrap the special status of Jammu and Kashmir and divide it into two union territories. Though most services, except mobile internet, were restored in Jammu within a week, Kashmir saw landlines and post-paid services being restored in phases.

"It has been decided to restore internet connectivity to all government hospitals with effect from midnight of 31 December besides fully restoring SMS on mobile phones," Jammu and Kashmir administration spokesman Rohit Kansal told reporters. However, internet and pre-paid mobile services in Kashmir are yet to be restored.

On 10 December, he had said machine-based SMSes were enabled for mobile phones in Kashmir in order to facilitate students, scholarship aspirants, traders and others, and that restoration of full message services was part of the process.

"Continuous efforts of the government have been to facilitate and move forward as much as possible and as quickly as possible, and ever since 5 August, we have been progressing in this direction both in Jammu and in Kashmir. We have been moving progressively forward and we will try to ensure as much and as quickly as possible," Kansal said in response to a question about restoration of Internet services.

He said that "our direction has been progressive, positive, and movement forward".

"We have been trying to take all possible steps slowly, surely but firmly in the form of restoration. These steps will continue," said Kansal, who is also principal secretary for planning, development and monitoring in the Union Territory administration of Jammu and Kashmir.

On 5 August, the Centre had abrogated Article 370 provisions that gave special status to J-K and bifurcated the erstwhile state into union territories of Jammu and Kashmir, and Ladakh.

Kansal said the administration in Kashmir is facilitating students, contractors, tour operators, government officials through various internet touch points.

"Nearly 900 such touch points and special counters are functional throughout Kashmir in districts, prominent tourist places and hotels, and about 6 lakh people have taken advantage of these touch points," the spokesman said.

In response to a question on release of detained politicians, including three former chief ministers, Kansal said that "any release or detention, preventive or otherwise, is a decision that is being taken by local law enforcing agencies based on its assessment of the local law and order situation".

"The same is being continuously reviewed. Some people were released yesterday, it is again a local assessment and review of the situation," he said.  Five political leaders, who had been under preventive detention since 5 August, were released from the MLA hostel in Srinagar on Monday. Former chief ministers Farooq Abdullah, Omar Abdullah and Mehbooba Mufti are still under detention.

Asked about the reasons for putting Congress leaders under house arrest in Jammu, Kansal said he does not have any information, but whenever local law enforcing agencies feel such a need based on their assessment of the situation, they carry out action accordingly.  He said despite repeated attempts by anti-national and anti-social elements, over 19 lakh metric tons of apple was exported.

In September, the government had introduced a market intervention scheme for procurement of apples, Kansal said. "This was when there was considerable concern and apprehension about the harvest procurement and transportation of apples, and when there was a concerted effort by anti-social and anti-national elements to attack everybody associated with the apple trade, to burn trucks as well as the harvested crop," he said.

Over 19 lakh metric tons of bumper harvest already stands exported and market intervention scheme stands extended to March 2020, the spokesman said. "Efforts of anti-national elements to harm the economy and livelihood of people have been thwarted," he said.

On demands from various quarters on reservation for educated local youths in government jobs, Kansal said, "there have been various suggestions that have been received by the government and these are under examination".

He denied any discrimination in distribution of compensation to farmers affected by unprecedented snowfall and rains in the regions of Jammu and Kashmir, and said "this government is absolutely fair, impartial and people friendly." The people will be given their rights in accordance to the rules, Kansal said.

At Delhi's Shaheen Bagh, anti-CAA protesters ring in 2020 with national anthem, 'inquilab zindabad', 'azadi' slogans

As the world geared up to bring in 2020, more than 3,000 people gathered at Delhi's Shaheen Bagh and Jamia Millia Islamia on New Year’s Eve against the Citizenship Amendment Act. The protesters decided to walk into the new decade while singing the national anthem and raising 'azadi' slogans.

The stage gave a platform to poets, professors, civil society groups, civic leaders, actors and students, belonging to Jamia, JNU and other colleges and schools to voice their opinions against the amended Citizenship Act.

Protesters held the tricolour even as the food, tea, fire wood, blankets, mattresses, heaters, water and medical supplies from well-wishers were distributed among the people. Such help to agitators has been offered ever since protests gained momentum on 15 December, days after the Parliament passed the Citizenship Amendment Bill by the Parliament.

‘No-CAA’ and ‘no-NRC’ stickers are now found everywhere, even as protesters chanted 'Azaadi' and 'Inquilab Zindabad'.

Anti-CAA protesters also staged demonstrations at several other places in Delhi, including Connaught Place’s Central Park and Saket’s PVR Anupam complex.

The protests at Shaheen Bagh have been going on for over two weeks even as temperatures continue to hover around the single-digit figure in Delhi. The stir on Tuesday was helmed by women, who led peaceful protests at a distance of few feet from the area that saw violent clashes on 15 December.

During the protest a fortnight ago, buses were set on fire after protestors and the police clashed. Several students and policemen were injured and around 100 students were detained. The police also allegedly entered the Jamia Millia Islamia campus and was accused of brutality against students.

According to the Citizenship (Amendment) Act, Hindus, Sikhs, Buddhists, Jains, Parsis and Christians who had come to India till 31 December, 2014, from Pakistan, Bangladesh and Afghanistan because of religious persecution will not be treated as illegal immigrants and be given Indian citizenship.

General Bipin Rawat takes charge as India's first Chief of Defence Staff, says armed forces have always stayed away from politics

New Delhi: Newly-appointed Chief of the Defence Staff General Bipin Rawat on Wednesday said the armed forces stay away from politics and work as per the directives of the government of the day, remarks that come amid allegations that the forces were being politicised.

General Rawat also said that his focus as CDS will be to integrate the efforts of the three services and to work as a team. "We keep ourselves away from politics. We act according to the directives of the government of the day," he said.

General Rawat said his focus will be to ensure best and optimal use of resources allocated to the three services.

Jammu and Kashmir administration abolishes toll tax from today at annual cost of Rs 1,500 cr to exchequer

Jammu: Jammu and Kashmir administration on Tuesday announced abolition of toll posts, including at Lakhanpur along Jammu-Pathankot highway, a move that will lead to a loss of Rs 1,500 crore to the exchequer annually.

The decision of the abolishment of the toll tax from the New Year was welcomed by traders while industrialists termed the withdrawal of toll tax as a "Black Death Warrant for J&K Industrial
Sector".

Announcing the decision at a press conference here, Principal Secretary, planning, monitoring and development Rohit Kansal said the government has decided to set up a High Powered Committee under the chairmanship of Advisor KK Sharma to interact with various stakeholders and to suggest measures to improve the competitiveness of local industry.

"The administration has decided to abolish toll tax at Lakhanpur and all other posts including at Railway Stations and Airports with effect from January 1, 2020. The abolition of the toll tax will lead to an annual loss of around Rs 1,500 crore to the UT coffers annually," he said.

In February, the administration had constituted a committee to examine the level of toll tax being levied on various products entering Jammu and Kashmir, production and export of locally produced products and modification, if any, as may be needed in the levy of toll tax.

"In exercise of the powers conferred by section 4 of the Jammu and Kashmir Levy of Tolls Act, the government of Jammu and Kashmir hereby directs that the toll post set up at Lakhanpur, district Kathua under the provisions of the Act, shall cease to operate with effect from January 1, 2020," Financial Commissioner Arun Kumar Mehta said in the notification.

Earlier on 6 February, 2018, the then Jammu and Kashmir government had abolished two major toll posts at Lower Munda along Jammu-Srinagar Highway in Anantnag district and Borehallan-Heerpur along Mughal road in Shopian district.

Reacting to the decision, President Jammu Chamber of Commerce and Industries Rakesh Gupta said the Lakhanpur Excise Toll levy was not less than a "Jizya tax" since 1995 that continued even after the implementation of GST in 2017.

"It will be a big sigh of relief to the common consumers from whose pockets this tax was being pick pocketed. The uninterrupted movement of goods shall result in less logistics cost and save time too," he said.

However, Jammu-based Bari Brahmana Industries Association (BBIA) raised serious concern over the decision, terming it as an attempt to "destroy" the Industrial sector of Jammu and Kashmir.

"The withdrawal of the toll tax will prove as a 'Black Death Warrant' for J&K Industrial Sector", BBIA said appealing the Lt Governor to review the decision.

Two Indian Army soldiers killed in gunfight with Pakistani infiltrators along LoC in Jammu and Kashmir's Rajouri

Jammu: Two army personnel were killed in a gunfight with heavily-armed Pakistani infiltrators along the Line of Control (LoC) in Jammu and Kashmir's Rajouri district on Wednesday, officials said.

The infiltrators were intercepted in the Khari Thrayat forest when they were trying to sneak into India from Pakistan-occupied Kashmir (PoK), they said.

"Two army soldiers martyred during cordon and search operation in Nowshera sector. The operation is still in progress and further details are awaited," Jammu-based Indian Army Public Relations Officer (PRO) Lt Col Devender Anand said in a statement.

The search operation was launched following information about the movement of suspected terrorists, the officials said.

The infiltrators opened fire on the troops and during a fierce gunfight, the two soldiers were killed, they said.

The officials said a massive operation is on in the area.

Indian Railways hikes fares for passenger trains across network; revised amounts to be applicable from 1 January

The Indian Railways raised the basic passenger fares across the nation on Tuesday, which will be applicable from 1 January, 2020. The revised fare table was published by the Indian Railway Conference Association (IRCA), reports said.

An order from the Railways said that fares for suburban trains would remain unchanged while the prices for ordinary non-air conditioned, and non-suburban trains had been hiked by one paise per kilometre.

Meanwhile, the fares of mail or express non-AC trains have been hiked by two paise per kilometre and fares for AC trains have been raised by four paise per kilometre. The hike will also apply to Shatabdi, Duronto, and Rajdhani express trains.

According to the order, there will not be any change in the reservation fee and superfast charge and the hike in fares will not be applicable to tickets already booked.

In Bulandshahr, the message to families who paid 'damages' for CAA protests is clear: Cough up and you'll face no harassment

They delved deep into their pockets and risked momentary humiliation to save themselves from years of disgrace. 

The decision by Bulandshahr's political leaders and villagers to hand over a cheque of Rs 6.27 lakh to the administration last week, didn't come  out of the blue. It was taken only after the administration had declared its intention to send them notices for the damages incurred during the 20 December protests against the CAA-NRC. One  police vehicle with a wireless communication set, and one more wireless set were  burnt.

 The villagers probably thought giving the money on their own would be a way of avoiding the inconvenience and worse, the ignominy of appearing in court repeatedly to prove that they hadn’t destroyed the property. While giving the money, not only did they express regret at the damage caused, but also requested the administration to withdraw cases against the villagers.

This kind of exchange, where an entire village gets together and pays for the damage caused by a few, in return for an end to conflict, is the way a panchayat works. But, do administrations work like this?

After a riot, a village can give a bond of good behaviour to the administration in return for dropping the cases. But where does the question of  money come in? 

Incidentally, no compensation was demanded by the very same administration a year ago, when one of their own officers was lynched by a mob of cow vigilantes led by the Bajrang Dal. Before lynching Inspector Subodh Kumar Singh on 3 December, 2018, the mob attacked a police post and burnt 15 police vehicles.

If the cost of one vehicle is put at Rs 6 lakh, this Bajrang Dal mob should have received notices for almost Rs one crore. But though the police, furious at the lynching of one of their own, vent their rage on the families of the suspects when they went looking for them, the administration remained unfazed by the lynching. No orders were given then by the chief minister that the rioters must pay for the damage, unlike now. After all, those rioters were fighting for a cause dear to his heart. 

In fact, most administrations have been remarkably lax in recovering damages from vandals, even when they’ve been ordered by courts to do so. The rioters' cause may not always be dear to their hearts, but the rioters' leaders are. 

So in Maharashtra, the two parties notorious for vandalism, the Shiv Sena and its offshoot the MNS, have mostly got away with letting their followers run riot. In fact, in 2010, the government gave their leaders a clean chit in court, when former Mumbai Police Commissioner Julio Rebeiro filed a PIL  asking that damages be recovered from the MNS, the Sena, and the Congress for four  acts of vandalism by their members. The the government's affidavit to the court said that during investigation, it could not be proven that top leaders of these parties (Bal Thackeray, Raj Thackeray and Narayan Rane, the ex-Shiv sena CM who had by then joined the Congress) instigated their followers. The workers had acted "on their own," it said.

However, the affidavit did state that compensation had been recovered in three of the four cases.

 Ironically, while the government was quick to exonerate top leaders, one of the accused himself urged the court to follow the principle of the leader taking responsibility.

"Why should I pay the fine for vandalism?" asked counsel for Shiv Sena trade union leader Sitaram Dalvi, who had been made to deposit Rs 2 lakh as part of the Rs 7.88 lakh fine imposed by the Collector for damages to a hotel by Shiv Sainiks. "Why not the Shiv Sena leaders? It is a vicarious liability. You can't foist it on me. You should foist it on Bal Thackeray or any other leader. They have booked 45 persons but I have been singled out (for paying the fine)." The morcha to the hotel had been led by Sanjay Raut, added Dalvi. 

The judges in turn pointed out that while informing the police on the party's letterhead about the morcha, Dalvi had said he would be leading it. But they gave him a day's time to contact his party bosses for the money. He came back the next day saying he could not do so.

It does not seem the amount was ever recovered.

Interestingly, it was during this hearing that the Bombay High Court directed the government to set up a "Claims Commissioner" as per a 2009 Supreme Court verdict. The deadline given was six weeks, but of course it was ignored. Just as the Supreme Court verdict itself has been ignored. Only now, after the anti-government protests, has the Delhi police asked the Delhi High Court to set up a Claims Commissioner office. 

In 2017, the Punjab and Haryana High Court took suo moto cognizance of the damage caused to public property by the Dera Sacha Sauda followers, who went on a rampage when the sect's leader Gurmeet Ram Rahim Singh was convicted of rape. The court ordered that the damages be recovered by attaching Singh’s property. However, it is doubtful that this was done.

To be fair to the Maharashtra government, it has not recovered damages even from the leaders of the 2012 Azad Maidan Muslim rally which erupted in violence. The Raza Academy, the Madinatullah Foundation  and 77 accused were sent notices by the Collector to pay up Rs 2.74 crore for damages caused in the violence which left 2 dead and 63 injured.  

This too was done only after a PIL was filed by two journalists. Eighteen of those who received the notices denied responsibility, including the Raza Academy. The Madinatullah Foundation had provided a fictitious address, so the notice never reached them.

At that time, the Collector had said that recovery would take a year, as each of those who had been sent notices would be given a hearing, and their versions would be cross-checked by eyewitnesses.

In Bulandshahr, no such procedure was followed. Yet the administration not only took the money, but publicised it as an example for others too. They seemed amenable to the message being sent out by one community: "Ok, we pay you, please stop the harassment."  Not too different from what roadside vendors in Mumbai do to local dadas, of both the police and political kind, in return for being  allowed to run their "illegal" stalls.

Photographer Ronny Sen 'attacked' in Kolkata for participating in anti-CAA protests, sustains minor injuries

Ronny Sen, a Kolkata-based photographer and filmmaker, was allegedly manhandled for his participation in the protests against the Citizenship Amendment Act (CAA) and National Register of Citizens (NRC) in West Bengal's Kolkata. Tweeting about the incident, Sen said that he was "attacked with a Bhojali (a dagger-like weapon)" on Monday night.

Sen filed a police complaint against Avijit Dasgupta, who has threatened the filmmaker on "several occasions" in the past, The Hindu reported.

"He repeatedly asked me to refrain from posting against the CAA and the NRC and (not to) participate in activities which he considers as anti-national. I am safe and unhurt. Immediately I lodged a police complaint last night. It is such a revelation that attacking, killing, shooting, people in the name of nationalism is so normal in today’s India," the report quoted him as saying after the incident.

Sen reportedly sustained a minor injury in the altercation.

New army chief Manoj Naravane says Pakistan uses terrorism as tool of state policy, asserts situation can't last long

In an apparent reference to Pakistan, army chief General MM Naravane on Tuesday said that the "neighbouring country" uses terrorism as a tool of state policy.

In an exclusive interview to ANI hours after taking the charge as the new army chief, General Naravane asserted that terrorism is a worldwide problem.

"Terrorism is a worldwide problem, India has been at the receiving end of terrorism for a long time. It is only now that the entire world and many countries affected with terrorism are coming to realise what a threat it is," he said.

"As far as our neighbour is concerned they are trying to use terrorism as a tool of state policy, as a way of carrying out a proxy war against us...while maintaining deniability. However, this state can't last long, as they say, you can't fool all the people, all the time," General Naravane added.

The new army chief said that post the abrogation of Article 370, there has been a definite improvement in the situation on the ground.

"Incidents of violence have seen a marked decline, this augurs very well for the population of Jammu and Kashmir. It is a step forward towards bringing peace and prosperity to the region," he said.

Manoj Naravane takes over as new Chief of Army Staff: Hope institution rises to greater heights, says predecessor Bipin Rawat

New Delhi: Outgoing Army chief General Bipin Rawat on Tuesday thanked all the army personnel and their families for extending full support to him in his three-year tenure at the helm of the 1.3 million force.

After a farewell Guard of Honour, General Rawat also hoped that the Army will rise to greater heights under the new chief General MM Naravane.

When asked whether the Army is better prepared now to face the security challenges facing the country he said: "Yes, we are better prepared."

General Rawat who interacted with media persons after receiving the Guard of Honour in the forecourt of the South Block also paid respects to the fallen soldiers at the National War Memorial on a chilly winter day.

"I express my gratitude to all soldiers who have stood steadfast under challenging circumstances, performing their duties, keeping the traditions of our armed forces. My special compliment to our soldiers on northern, western and eastern borders who are braving tough winter and icy winds, steadfastly in guarding our country," General Rawat said.

General Rawat also congratulated Gen Manoj Mukund Naravane took charge as the 28th Chief of Army Staff on Tuesday.

"I convey my best to each and every rank and file of the Indian Army. I also congratulate Gen Naravane on being the next Army Chief. He is a very competent and capable officer. Gen Naravane through his competence and professionalism will take Army to greater heights," Gen Rawat said.

Gen Rawat who has been appointed India's first Chief of Defence Staff will helm the newly created department of military affairs. The tri-service agencies, organisations and commands relating to cyber and space will be under the command of the CDS, and he will also function as the Military Adviser to the Nuclear Command Authority.

Asked about his priorities as the CDS, he said, "I totally focussed on my job as a Chief of Army Staff. I will think about my next job after I assume the next office."

Gen Rawat assumed charge as Chief of Army Staff on 31 December, 2016, and retires from the post after a distinguished career.

Before becoming the Army Chief, he handled various operational responsibilities in many areas, including along the LoC with Pakistan, the LAC with China and in the Northeast.

Jammu and Kashmir Congress president GA Amir put under house arrest ahead of planned visit to Valley despite receiving permission

Jammu: Jammu and Kashmir Congress president GA Mir and several other senior leaders were placed under house arrest on Tuesday ahead of their planned visit to parts of the Jammu region and south Kashmir, according to a party leader.

Mir along with former deputy chief minister Tara Chand and senior vice president and former minister Raman Bhalla were placed under house arrest on Tuesday morning, Jammu and Kashmir Pradesh Congress Committee (JKPCC) chief spokesperson Ravinder told PTI.

He said several other former legislators, ministers and youth leaders were also directed not to move out of their houses by police.

Police officials were not immediately available for a confirmation.

Talking to PTI, Mir said, "We decided to visit parts of Jammu region and South Kashmir and sent a formal request to the government. We were granted permission. But this morning, when we were supposed to leave for the visit, police was there at my house and the houses of other leaders. They told us that we are under house arrest".

A party delegation under his leadership was supposed to visit different areas including Udhampur, Ramban and south Kashmir to interact with party workers, he said.

"Police and government should have sent a formal letter to us for denial of permission, when we had written to them," he said.

Condemning the administration for the action, Sharma said "on the one hand, the government is making claims of normalcy in Jammu and Kashmir and on the other they are not allowing the opposition to undertake political activity. Their claim of normalcy is hollow."

"One fails to understand why BJP leaders are allowed to move freely, while curbs are being put on the opposition to keep them away from the public," he said.

Nationwide protests against Citizenship Amendment Act, NRC are noisy and chaotic but vital to furthering interests of constitutionalism

The Constitution of India and its Preamble were reduced to mere words when the Indian government gazetted the controversial Citizenship Amendment Act, 2019 on 12 December.

As expected, protests followed in many parts of the country. Prompt Section 144 orders were imposed, and communication channels were blocked in many states. Thousands of unarmed protesters, who came out to resist majoritarian norms, were detained and were denied basic legal and medical services. Close to 30 people reportedly died.

While favourable orders came from the Gauhati and Karnataka high courts, the Supreme Court and the Delhi High Court, under whose nose hundreds of students were brutally assaulted inside the campus of Jamia Millia Islamia University, chose not to intervene.

That millions of people hit the streets and that the government employed every tool at its disposal to prematurely contain the protests signal a clear anti-government sentiment. The Citizenship Amendment Act is widely seen as a legal tool to further the NDA government’s “us-versus-them” philosophy, which puts Hindus first on any political agenda. When clubbed with the National Register of Citizens, the Act has the potential to turn a vast number of Indian Muslims into stateless persons for all practical purposes, leading to deportation or detention.

The protests also signal a pro-Constitution sentiment. Those protesting believe that a discriminatory law such as the Act has no place in a democracy run and guided by the principles enshrined in the Constitution, the people’s book. However, at times, the Constitution is only part of the problem, and not the solution. No wonder then that even those who stand in favour of the discriminatory Act read out Articles from the very same Constitution.

For instance, in Parliament, home minister Amit Shah read out the equal protection clause stipulated in Article 14 of the Constitution accompanied by a long list of Supreme Court judgments in support of the constitutionality of the Act. Several “eminent” lawyers appeared on prime-time TV debates pronouncing upon the constitutionality of the Act, while taking recourse to legal jargon. When police lathi-charged students studying inside the library of Jamia Millia Islamia University, sections from the Criminal Procedure Code were invariably shared on social media in justification of police trespass and brutality.

A new narrative is deceptively being built, i.e. protests are anti-democratic and anti-Constitution and that citizens must take recourse to constitutional means to confront the government in power. Certain sections of the media are acting hand in glove to further this “counter-protest” strategy of the ruling dispensation.

There is no denying that the right to protest has limits and violence cannot be justified: in fact, damaging public property only emboldens the law enforcement agencies and also delegitimises protests in people’s eyes. In any event, most protests against the Act have been peaceful and in rare cases where violence was reported, it is still unclear if the violence was instigated, directly or indirectly, by state governments. However, it is important not to let abstract legal precepts or legal niceties constrain our loyalty and commitment to some of the first principles of justice and fairness. Even with all the constitutional and legal constraints, there exists enough room to stage non-violent, unarmed and democratic protests in public spaces.

And how exactly, if I may ask, should one confront the government when institutional means of redressal of grievance seem to be wholly inadequate? How does one make an elected government accountable in the beginning or middle of an electoral cycle, when the ballot box cannot be immediately used? Of course, one could wait to vote an unjust government out of power every five years, but doesn’t waiting and slogging for justice perpetuate further injustice?

Or, one could turn to the Supreme Court (or high courts for that matter) against government excesses for urgent redressal. However, the less said about the court the better: in the recent past, the court has denigrated itself from a guardian of civil liberties to an extended bureaucracy, conveniently abdicating its judicial responsibility when citizens needed it the most.

Legal and constitutional challenges to government excesses, as we saw in the cases of demonetisation and Aadhaar, take too long and it has so happened that the court decided a matter of immense public interest not until the same became fait accompli.

Besides, when the Supreme Court will eventually examine the constitutionality of the Act, it will do so within the confines of judicially evolved principles of equal protection, which can be tweaked one way or another. As Professor Shubhankar Dam reminds us in a recent article, we should not conflate constitutionality with justice or wisdom: constitutionality of a law is only one of the many ingredients of justice. In a democracy, moral criticism and civil protests against an unjust and imprudent law are not only desirable but are also necessary and obligatory.

No one disagrees with the fact that a citizen has a moral duty to respect, obey and comply with a law made by Parliament. However, this moral duty is not absolute and there also exists a moral right to disobey and disrespect a law that is inherently and grievously unjust, immoral and unconstitutional. The Citizenship Amendment Act, 2019, which effectively arbitrarily singles out Muslim illegal immigrants and unreasonably abridges their fundamental rights, is a sad example of such a law.

Many would cast doubt on the legality of the declarations made by the chief ministers of Chhattisgarh, Kerala, Punjab, Madhya Pradesh, Maharashtra and West Bengal – all Opposition-ruled states – that they will not implement the Act in their respective states.

Constitutionally speaking, Parliament is empowered to legislate on citizenship matters under Article 246, read with Entry 17 of List I in the Seventh Schedule to the Constitution. It is also correct to argue that the Act is valid and operative in India, as it has not been stayed or struck down by the Supreme Court. The Central government can direct compliance with the Act under Article 256. The President may also declare, under Article 365, that the government in the respective state cannot be carried out in accordance with the Constitution.

But we must look beyond centre-state relations and look for answers to the following vital questions: can the Central government read and apply the Constitution selectively as per its whims and fancies? Can the Central government enforce and implement one Part of the Constitution to direct state governments to comply with a law that flies in the face of another Part of the very same Constitution? Would state governments not lose their legitimacy if they acted in conformity and supported and implemented a patently unconstitutional, immoral and discriminatory law?

When we speak of law or rule of law, can a law made by Parliament or a decision handed down by a court of law – even when coming from the highest court of the land – qualify as “just” and “moral” if it goes against basic human values of equality and fairness?

A reasoned and principled protest, accompanied by a willingness to submit to punishment or prosecution (for instance, by defying Section 144 orders), will mean that we do not leave the cause of justice and fairness with legislators and judges alone. It will also mean that the people of the country, from whom the government derives its ultimate authority, are in constant vigil of their constitutional rights and liberties. The protests against the Citizenship Amendment Act has gained significant and sustained engagement and we must strive to keep up the momentum.

In Bulandshahr, families wrecked by CAA violence pay UP administration 'damages', beg state to withdraw cases so they can avoid ignominy of court appearance

They delved deep into their pockets and risked momentary humiliation to save themselves from years of disgrace. 

The decision by Bulandshahr's political leaders and villagers to hand over a cheque of Rs 6.27 lakh to the administration last week, didn't come  out of the blue. It was taken only after the administration had declared its intention to send them notices for the damages incurred during the 20 December protests against the CAA-NRC. One  police vehicle with a wireless communication set, and one more wireless set were  burnt.

 The villagers probably thought giving the money on their own would be a way of avoiding the inconvenience and worse, the ignominy of appearing in court repeatedly to prove that they hadn’t destroyed the property. While giving the money, not only did they express regret at the damage caused, but also requested the administration to withdraw cases against the villagers.

This kind of exchange, where an entire village gets together and pays for the damage caused by a few, in return for an end to conflict, is the way a panchayat works. But, do administrations work like this?

After a riot, a village can give a bond of good behaviour to the administration in return for dropping the cases. But where does the question of  money come in? 

Incidentally, no compensation was demanded by the very same administration a year ago, when one of their own officers was lynched by a mob of cow vigilantes led by the Bajrang Dal. Before lynching Inspector Subodh Kumar Singh on 3 December, 2018, the mob attacked a police post and burnt 15 police vehicles.

If the cost of one vehicle is put at Rs 6 lakh, this Bajrang Dal mob should have received notices for almost Rs one crore. But though the police, furious at the lynching of one of their own, vent their rage on the families of the suspects when they went looking for them, the administration remained unfazed by the lynching. No orders were given then by the chief minister that the rioters must pay for the damage, unlike now. After all, those rioters were fighting for a cause dear to his heart. 

In fact, most administrations have been remarkably lax in recovering damages from vandals, even when they’ve been ordered by courts to do so. The rioters' cause may not always be dear to their hearts, but the rioters' leaders are. 

So in Maharashtra, the two parties notorious for vandalism, the Shiv Sena and its offshoot the MNS, have mostly got away with letting their followers run riot. In fact, in 2010, the government gave their leaders a clean chit in court, when former Mumbai Police Commissioner Julio Rebeiro filed a PIL  asking that damages be recovered from the MNS, the Sena, and the Congress for four  acts of vandalism by their members. The the government's affidavit to the court said that during investigation, it could not be proven that top leaders of these parties (Bal Thackeray, Raj Thackeray and Narayan Rane, the ex-Shiv sena CM who had by then joined the Congress) instigated their followers. The workers had acted "on their own," it said.

However, the affidavit did state that compensation had been recovered in three of the four cases.

 Ironically, while the government was quick to exonerate top leaders, one of the accused himself urged the court to follow the principle of the leader taking responsibility.

Assam TET Result 2019: The Assam Teacher Eligibility Test result 2019 for lower and upper primary was released by the State Board of Secondary Education on Tuesday on its official website — ssa.assam.gov.in or sebaonline.org. Candidates who attempted the entrance exam can visit the official website to check the result and will need the registration number and password to access their scores on the site.

Following a meeting with Rahul, Congress leaders from Maharashtra are expected to pay a courtesy visit to party interim president Sonia Gandhi. The meetings come a day after a total of 36 leaders from Shiv Sena, Nationalist Congress Party (NCP) and Congress, including Ajit Pawar and Aaditya Thackeray, on Monday took oath as ministers in the Maharashtra government.

Congress leaders Ashok Chavan, Dilip Walse-Patil, Dhananjay Munde, Sunil Chhatrapal Kedar and KC Padavi were sworn-in as ministers the Maharashtra Cabinet. However, they are yet to be assigned portfolios.

On 28 November, Uddhav Thackeray took oath as Chief Minister bringing an end to weeks of political instability in the state's politics after Shiv Sena, NCP and Congress stitched a post-poll coalition as Maha Vikas Aghadi.

UGC NET December Result 2019: NTA to release score today on ugcnet.nta.nic.in; candidates advised to keep admit card handy

UGC NET December Result 2019 | The National Testing Agency (NTA) will announce the UGC NET result for the December 2019 exam on Tuesday (31 December) on its official website ugcnet.nta.nic.in.

NTA chairman Vineet Joshi told NDTV that the exam was conducted for over 10 lakh candidates in 81 subjects. UGC NET December 2019 exam concluded on 6 December and NTA released the provisional answer key on 10 December. The final answer key was released on 23 December.

Candidates are advised to keep their admit card handy as they will be asked to enter their registration number and password to check the score. Candidates can follow these steps to check the result:

According to Indian Express, while everyone who scores 40 percent (35 percent for reserved category) will pass the exam, only the top six percent – based on merit – will be considered eligible for the jobs.

In UGC NET July 2019 result, a total of 4,756 candidates cleared for the JRF while 55,701 had cleared the NET for assistant professor only. Those who are eligible to apply for JRF fellowship can also apply for assistant professor jobs but those who are selected for assistant professor roles are not eligible to apply for JRF.

On behalf of University Grants Commission (UGC), the National Eligibility Test (NET) is conducted for determining the eligibility of Indian nationals for the Eligibility for Assistant Professor only or Junior Research Fellowship and Assistant Professor both, in Indian universities and colleges. Till June 2018, the CBSE conducted the NET in 84 subjects at 91 selected cities of spread across the country. Since December 2018 onwards, the UGC- NET is being conducted by the NTA.

Jadavpur University professor attacked while returning from anti-CAA rally, claims BJP activists beat her for objecting to hate speech

Kolkata: A Jadavpur University teacher has alleged that she was "roughed up" by a few women activists of the BJP near the varsity campus for protesting against the disparaging remarks made against the institute and a particular community by a saffron camp member.

The BJP leadership, however, denied any involvement in the incident and said several "ultra-Left supporters" had staged an agitation in the vicinity of a party meeting, near the campus, on Monday, but its workers maintained restraint.

Taking to Facebook, Doyeeta Majumder, assistant professor of the English department at the university, said, "On my way back from an anti-CAA rally, I ran into a saffron outfit at 8B, and got totally roughed up and hit by BJP 'bhodromohilas' (gentlewomen)".

Majumdar claimed that that the women were "baying for her blood" and the incident left her shuddering with fear.

"The saffron speaker was spewing naked hate speech... for a good few minutes, then turned and pointed at the campus and started saying 'this University is the root of all evil, they all chant Allahu Akbar every day'. I snorted out loud and shouted 'mithye kotha' (lies lies) twice.

"That is all it took. In seconds I was surrounded by a mob of mashima-like (middle-aged) women who started pushing me down and hitting me. A young man tried to protest, he was roughed up too. Ultimately I was dragged kicking and screaming by two (presumably BJP) men who kept saying 'Didi ar jhamela baraben na, chole jan, chole jan' (didi please don't create further trouble, leave now).

The professor also said that she has filed a complaint with police along with two of her students, who had tried to help her and "got beaten up worse".

"Those women....were literally baying for my blood. I am fine, no lasting harm done, only shuddering at the infinite horrors in store for us," she wrote.

According to state BJP sources, party's Rajya Sabha MP Swapan Dasgupta, Lok Sabha MP from Bongaon, Santanu Thakur, and senior state BJP leader Shamik Bhattacharya were among those present at Monday's meeting outside the campus.

"As we were conducting a meeting, some supporters of ultra-Left parties came near the venue and started raising slogans. They even pushed our cadres. But we maintained restraint. None of our cadres were involved in any assault," Bhattacharya said.

According to a senior police officer, barricades were put up between the members of two groups as they "engaged in sloganeering and counter-sloganeering".

"We put up a barricade between the two groups in order to avoid any untoward incident. Two complaints have been filed by a JU professor and some other members of the university. We are looking into the matter," he said, refusing to divulge further details.

Denouncing the "assault", the general secretary of Jadavpur University Teachers Association, Partha Pratim Roy, said, "One of our colleagues, Dr Doyeeta Majumder of the English Department, has been attacked by BJP activists at Jadavpur 8B. We strongly condemn this activity of the political hooligans."

‘Govt has started on wrong foot on Chief of Defence Staff appointment': Congress’ Manish Tewari says post fraught with ambiguities

New Delhi: The Congress on Tuesday raised several questions over the appointment of Gen Bipin Rawat as the Chief of Defence Staff (CDS), saying the government has started on a "wrong foot" on the issue. The party also asked whether the country was headed on a portentous path.

Congress spokesperson Manish Tewari said the government has started on a wrong foot on the appointment and only time will unfortunately reveal the implications. "With great regret and fullest of responsibility may I say that the Govt has started on a very wrong foot with regard to CDS. Time alone unfortunately will reveal the implications of this decision," he said on Twitter.

He also asked why the appointment of a CDS is fraught with difficulties and ambiguities. "What implications does nomenclature Principal Military Advisor to Defense Minister have in relation to the three service chiefs in terms of Military advise tendered to the government?Will the advise of the CDS override the advise of the respective Service Chiefs," he asked.

Tewari wondered if the CDS as Permanent Chairperson of Joint Chiefs of Staff Committee outrank the three service Chiefs. "Would the three Chiefs report to Defense Minister through Defense Secretary or through CDS now," he asked.

"What will be the position of CDS qua Defense Secretary?Would the Defense Secretary in terms of Rule 11 of Transaction of Business Rules continue to be the administrative head of the Defense Ministry ?What is the remit/mandate of the proposed Department of Military Affairs?"

"Would the CDS overide the Service Chiefs with regard tri Service agencies and organisations. What are the implications of the appointment of a CDS on Civil Military Relations- the equilibrium of which has been India's singular Success since 1947? Are we down a portentous path," he questioned.

Opposition creating ‘fear among Muslims' over CAA for vote bank politics, says Goa CM Pramod Sawant

Panaji: Goa Chief Minister Pramod Sawant on Monday said the opposition was creating an "illusion" about the Citizenship Amendment Act for "vote bank politics". It is a "desperate attempt" of the opposition to spread fear among Muslims, he alleged.

Sawant said Indian citizens belonging to any religion need not worry either about the Citizenship Amendment Act (CAA) or the National Register of Citizens (NRC).

Various parties, including the Congress and NCP, have been opposing the CAA, which seeks to grant citizenship to non-Muslim refugees who came to India before 31 December, 2014, to escape religious persecution in Pakistan, Bangladesh and Afghanistan.

Hitting out at those against the Act, Sawant, in a series of tweets, said, "The opposition is spreading illusions for vote bank politics, it is being propagated amongst Muslims that CAA is a law to take away their citizenship. This is nothing but a desperate attempt by the opposition to spread fear among Muslims."

The CAA has been enacted through a democratic process and gives citizenship to refugees who have had "centuries of cultural affinity with Indian ethos", he further tweeted. "Indian citizens belonging to any religion need not worry at all, either about CAA or NRC," he said.

"The CAA does not change any existing legal provision which allows any foreign national to apply for Indian Citizenship through registration/naturalization," the chief minister said in another tweet.

He said the new law "empowers persecuted minorities" in Pakistan, Afghanistan and Bangladesh by giving Indian citizenship. "It applies to those who have migrated before 31 December, 2014, on establishing their residency in India for five years."

"CAA categorically addresses concerns of minorities of Pakistan, Afghanisthan and Bangladesh. Members of the majority community in these countries who want to apply for Indian Citizenship will still be able to, as per the existing provisions of Indian Citizenship," Sawant added.

The BJP has been holding awareness campaigns in different Assembly segments of Goa in support of CAA.

JNU to implement new hostel manual from Wednesday; students who boycotted exams allowed to provisionally register for next semester

New Delhi: The Jawaharlal Nehru University on Monday said it will implement the new hostel manual from Wednesday, with its Vice-Chancellor appealing to the students to call off their strike.

After a meeting of all the three Rectors, the university's Registrar, the Deans of Schools and Chairpersons of the Special Centres, a circular was also issued urging the students, who have completed their "academic requirements of Monsoon semester 2019", to register for the new semester between 1 and 5 January, 2020.

For those who have not completed the "academic requirements" provisional registration will be allowed during the same period, the varsity said. It said the provisionally registered students are required to complete the "academic requirements" by 20 January, 2020 to keep their registration valid.

The Deans and Chairpersons will ensure that evaluations, examinations and grading of all the provisionally registered students are completed on or before January 20, 2020, the varsity said. For all the students, winter semester will start as per the academic calendar, it said.

According to a varsity official, the students who boycotted exams and did not take the tests even the question papers were sent to them through email and WhatsApp have been given another chance. "They can provisionally register for the semester, take exams at their respective schools and the results will be declared by 20 January," a varsity official said.

Saket Moon, the vice-president of the JNU students' union, said the students had a meeting with the varsity Registrar and Rector where some issues were discussed. He said the students' union will hold a meeting to decide whether they will take the exams or not. The students of the university have been on a strike for over two months against the hostel manual as it has provisions for fee hike and levies service and utility charges.

However, a JNU official said the service and utility charges will be taken care of by the University Grants Commission and will not be levied on the students.

The varsity's vice-chancellor, Mamidala Jagadesh Kumar, wished the students well for the New Year and cited the varsity's achievements. He also expressed concerns saying, "certain recent incidents have deeply impeded the forward march of our university". "It is difficult to fathom what prompted our students to take the path of confrontation and disruption affecting the teaching and research work towards the end of the Monsoon Semester 2019," he said.

Although the university administration and the relevant bodies followed the statutory process for revising the room rent and hostel charges, a false impression was created as if the administration was bringing about these changes to harm the students, Kumar said. He explained that the nominal increase in the hostel charges was necessitated owing to a mounting fiscal pressure on the University budget, and to maintain a comfortable and conducive hostel accommodation.

The administration made several attempts to establish meaningful dialogues with the agitating students to explain the rationale behind the new hostel charges, Kumar said.

The agitating students prevented the teachers and other students from entering few school buildings, he added. "The university is giving yet another chance to the students to complete their academic requirements of Monsoon semester 2019. I appeal to the agitating students to call off their strike and lockdown of certain school buildings," Kumar said.

Kota infant deaths: NCPCR finds JK Lon Hospital in dire state; acute staff shortage, pigs inside campus among many lapses at institution

New Delhi: Broken windows and gates, pigs roaming inside hospital campus and acute shortage of staff were among the findings of the apex child rights body NCPCR during inspection of JK Lon Hospital in Kota where 940 children died this year.

A team from the National Commission for Protection of Child Rights team visited the hospital after which its chairperson Priyank Kanoongo issued a show cause notice to Vaibhav Galtiya, Secretary of Medical Education Department in Rajasthan government, and sought an action taken report from him on its findings.

"It is evident that there was no glass in windows panes, gates were broken and as a result the admitted children were suffering with extreme weather condition,"  Kanoongo said. He also said that the general upkeep and maintenance of the hospital is in the "worst condition".

"Pigs were found roaming inside the campus of the hospital," he said in the notice. Kanoongo also said that there was acute shortage of staff.

He has sought the action taken report within three working days.

Delhi Police arrests 11th person in connection with 15 Dec Jamia violence; accused was previously involved in Arms Act case

New Delhi: A 25-year-old man was arrested on Monday for his alleged involvement in the violence near Jamia Millia Islamia around a fortnight ago, police said.

The accused, Asad Ansari, was arrested from Kalkaji area, they said. According to police, the man, a resident of Jamia Nagar, was previously involved in a case of Arms Act. He was identified through videography and technical surveillance, they said.

Ansari was found indulging in violence outside the Jamia Millia Islamia and seen pelting stones, a senior police officer said.

So far, a total of 11 people have been arrested in connection with violence near Jamia Millia Islamia, he said.

On 15 December, the university had turned into a battlefield as police entered the campus and also used force, following protest against the Citizenship Amendment Act, which led to violence and arson in which four DTC buses, 100 private vehicles and ten police bikes were damaged.

Bengaluru: BJP national general secretary Ram Madhav said on Monday that both "innocent" and "not so innocent" people have died in the violent protests against Citizenship Amendment Act, 2019 across the country.

Madhav was speaking at an event on the Citizenship Amendment Act (CAA). "The protests by the Opposition have led to violence and unrest in several parts of country and lives of innocent and not so innocent people have been lost," said Ram Madhav.

"This Act is not for excluding someone but it is for giving the citizenship to those who have faced religious persecution in Pakistan, Afghanistan and Bangladesh," said Madhav. "BJP is not against granting citizenship to Muslim, had it been so we would not have given citizenship to singer Adnan Sami who is from Pakistan," he added.

He said that the minds of the leaders opposing the Citizenship Amendment Act (CAA) are "knowledge and information proof". "In our school days, there was a fashion of waterproof watch. It is the type of watch in which water doesn't enter. Similarly, the mind of opposition leaders who are opposing the CAA is knowledge proof and information proof," said Ram Madhav.

The new law grants citizenship to Hindus, Sikhs, Jains, Parsis, Buddhists and Christians from Pakistan, Afghanistan and Bangladesh who came to India on or before 31 December, 2014.

Mukund Naravane to take charge as army chief on Tuesday; Bipin Rawat to begin tenure as Chief of Defence Staff today

New Delhi: Lt Gen Manoj Mukund Naravane will take charge as the Chief of Army Staff on Tuesday succeeding Gen Bipin Rawat.

Gen Rawat has been appointed India's first Chief of Defence Staff. He was to retire on Tuesday as Army Chief after a three-year stint.

Lt Gen Naravane is currently serving as Vice Chief of the Army. Before taking charge as vice chief of the Army Staff in September, Lt Gen Naravane was heading the Eastern Command of the Army which takes care of India's nearly 4,000-km border with China.

In his 37 years of service, Lt Gen Naravane has served in numerous command and staff appointments in peace, field and highly active counter-insurgency environments in Jammu and Kashmir and the Northeast. He has also commanded a Rashtriya Rifles battalion in Jammu and Kashmir and an infantry brigade on the eastern front.

He was also part of the Indian Peace Keeping Force in Sri Lanka and had served as India's defence attache at the Indian Embassy in Myanmar for three years.

Lt Gen Naravane is an alumnus of the National Defence Academy and the Indian Military Academy.

He was commissioned into the 7th battalion, the Sikh Light Infantry Regiment in June 1980.

The General is a decorated officer who has been awarded the 'Sena Medal' (Distinguished) for effectively commanding his battalion in Jammu and Kashmir.

He is also a recipient of the 'Vishisht Seva Medal' for his services as the Inspector General Assam Rifles (North) in Nagaland and the 'Ati Vishisht Seva Medal' for commanding of a prestigious strike corps.

Gen Rawat has been appointed as CDS with effect from 31 December. The defence ministry on Saturday amended rules to allow the Chief of Defence Staff to serve up to a maximum age limit of 65 years.

The changes have been made in the services rules of the Army, Navy and the Indian Air Force for extension of retirement age of the Chief of Defence Staff to a maximum of 65 years if a service chief is appointed to the post.

In a landmark decision, the Cabinet Committee on Security had last Tuesday approved the creation of the CDS who will act as the principal military adviser to the defence minister on all matters relating to tri-services.

A key mandate of the CDS will be to facilitate restructuring of military commands for optimal utilisation of resources by bringing about jointness in operations, including through establishment of joint/theatre commands.

Officials said bringing about jointness in operation, logistics, transport, training, support services, communications, repairs and maintenance of the three services within three years will be another major mandate of the CDS.

The tri-service agencies, organisations and commands relating to cyber and space will be under the command of the CDS and he will also function as the Military Adviser to the Nuclear Command Authority.

Gen Rawat assumed charge as Chief of Army Staff on 31 December, 2016. Before becoming the Army Chief, he handled various operational responsibilities in many areas, including along the LoC with Pakistan, the LAC with China and in the Northeast.
